The petitioner is in custody in a case registered under Sections 374/39 of the Indian Penal Code. The prosecution case, in brief, is that the informant Dharamveer Kumar filed written information before the S.H.O., Rail Police Station, Raxaul stating therein that his mother Kishori Devi and father while boarding train at Platform No. 2, one person snatched the golden chain from his mother's neck and handed to over it to another person and both started fleeing, however, with the help of police one person was apprehended, but on search nothing was found from the possession of the apprehended person. Thereafter, Raxaul Rail Police Station Case No. 08 of 2015
Patna High Court Cr.Misc. No.25309 of 2015 (2) dt.21-07-2015 against the accused persons.
It is submitted on behalf of the petitioner that the petitioner is in custody since 30.04.2015. It is further submitted that there is no recovery of any incriminating articles from the possession of the petitioner. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Rail Judicial Magistrate, Bettiah, West Champaran, in connection with Raxaul Rail Police Station Case No. 08 of 2015.
