Perused the impugned order dated 04.06.2016 passed in Title Execution Case No. 09 of 2010. The order is routine order. Therefore, no right of the parties has been decided. Thus, the order cannot be interfered with in exercise of supervisory jurisdiction. 3.
So far the submission of learned counsel for the petitioner that the Miscellaneous Case No. 06 of 2013 has been filed under Order 21 Rule 99 and 101 C.P.C. is concerned, no order refusing the stay has been produced before this Court. It appears that on the same date i.e. 04.06.2016, the miscellaneous case has been admitted. Therefore, the petitioner may pray for stay before the executing court. If prayer is made, the court below shall decide the same in accordance with law. This civil miscellaneous application is, thus, dismissed.
