The petitioners are in custody in connection with Paraiya P.S. Case No. 96 of 2019 for the offences under Section 30(a) of the Bihar Excise Amendment Act, 2018. Learned counsel for the petitioners would submits that in the instant case 55 liters of illicit liquor was seized but nothing was recovered from the conscious possession of the petitioners and he has no concern with the seized liquor. No.54980 of 2019(3) dt.05-09-2019 2/2 criminal antecedent, the Court is inclined to grant bail to the petitioners, let the petitioners, named above, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Court of learned Special Judge, Excise, Gaya in connection with Paraiya P.S. Case No. 96 of 2019, subject to the condition that the petitioners shall deposit cash of Rs. 25,000/- each before the court below and the amount shall abide by the final outcome of this criminal case i.e. Cr. Misc. 54980 of 2019. If the petitioners are convicted the amount of Rs. 25,000/- deposited before the court below shall be forefitted otherwise refunded.
