JUSTICE RAKESH KUMAR ORAL ORDER 01-07-2017 Heard learned counsel for the petitioner and Sri Ram Naresh Ray, learned Addl. Public Prosecutor. The sole petitioner, apprehending arrest in Jehanabad Mahila P.S. Case No.17/2016 registered for the offence under Sections 341, 342, 354, 323, 504, 506/34 of the Indian Penal Code and Section 8 of POCSO Act, has prayed for grant of bail, in the event of his arrest or surrender primarily on the ground that coaccused Ranjan Yadav having similar accusation has been extended the privilege of anticipatory bail by order dated 20.08.2016 vide Cr.Misc.No.27634 of 2016.

It was submitted by learned counsel for the petitioner that the petitioner was falsely implicated in the present case and this was the reason that the police has submitted final

Patna High Court Cr.Misc. No.21746 of 2017 (2) dt.01-07-2017 2/2 report against the petitioner. However, differing with the police report, the learned Magistrate has taken cognizance against him. On the aforesaid ground, a prayer has been made for grant of anticipatory bail.

Considering the fact that the police after investigation has submitted final report against the petitioner, there is no reason to deny the prayer for anticipatory bail. Let the petitioner, namely, Nagmani Yadav, in the event of his arrest or surrender within six weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge 1st, Jehanabad in connection with Jehanabad Mahila P.S. Case No.17/2016, subject to condition as laid down in Section 438(2) of the Code of Criminal Procedure.
