2. The petitioner seeks bail in connection with Bibhutipur P.S. Case No. 148 of 2002 registered for the offence under Sections 302 and 34 of the Indian Penal Code and under Section 27 of the Arms Act.

3. Though, the petitioner is named in the FIR as one of the co-accused but after investigation, the police has exonerated him and charge-sheeted only Satish Paswan but the Magistrate concerned has differed with the Final Form and has taken cognizance against the petitioner and he is in jail since 22.4.2024.

4. Considering the aforesaid facts, this application is allowed.

5. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Rosra, Samastipur / concerned Court below in connection with Bibhutipur P.S. Case No. 148 of 2002.
