JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 467,468,423,424,420 and 197 of the Indian Penal Code. The accusation is of transferring 2.66 acres of land belonging to Bhudan Yagya Committee and getting the same recorded in revenue records in the name of accused persons. It is submitted by the learned counsel for the petitioners that the case was filed on behalf of informant as BLDR No. 102 of 2011-12 before the Circle Officer, Thakurganj whereby the land was declared to be of Bhudan Yagya Committee but the said order

Patna High Court Cr.Misc. No.25998 of 2015 (2) dt.01-07-2015 2/2 was unsettled by the Divisional Commissioner vide order dated 9.5.2013 passed in Land Dispute Appeal No. 243 of 2012-13 and for the same cause of action the present FIR has been registered. It is further submitted that Pothia (Paharkatta) P.S. Case No. 69 of 2012 was registered with similar accusation in which accused Sita Choudhary has been granted anticipatory bail vide Cr. Misc. No. 54461 of 2013. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Kishanganj in connection with Pothia (Paharkatta) P.S. Case No. 61 of 2012 subject to the conditions as laid down under Section 438(2) Cr.P.C.
