====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 10-05-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Turkauliya (Banjariya) P.S. Case No. 206 of 2019 registered under Sections 324, 307, 120(B), 506 and 34 of the Indian Penal Code read with Section 27 of the Arms Act.

Learned counsel for the petitioner submits that petitioner is in custody since 20.03.2020, charge-sheet has been submitted in the case, has antecedent of five cases and the informant alleges that two unknown persons came on a motorcycle and fired on the informant, thereafter one Raj Tilak Singh also fired causing firearm injury to the informant on his shoulder, abdomen and right hand.

Learned counsel submits that petitioner has been falsely implicated in the present case, petitioner is not named in the F.I.R., his name transpired in the confession statement of the co-accused

Patna High Court CR. MISC. No.68340 of 2021(2) dt.10-05-2022 2/2 Chandan Ram who has been granted bail by order dated 27.05.2020 in Criminal Misc. No. 75785/2019.

The learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 20.03.2020, charge-sheet has been submitted in the case, is not named in the F.I.R and his name transpired in the confessions statement of co-accused who has been granted bail, let the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Turkauliya (Banjariya) P.S. Case No. 206 of 2019 with a condition that one of the bailors shall be the father of the petitioner namely Gautam Ram. Further, if the learned court below comes to a conclusion that the petitioner after his release is trying to delay the trial in any manner, the learned court below shall, forthwith, cancel his bail bond after recording reason.
