The petitioner apprehends his arrest in connection with Jagdishpur P.S. Case No. 20 of 2017, registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code.

Allegedly, Monika Kumari aged about 16 yeas, the sister of the informant was kidnapped by the petitioner and others. Submission is of false implication and that the victim has been recovered and her statement has been recorded under Section 164 of Cr.P.C. wherein she has stated that she has married with Deepak Kumar Singh out of her own sweet will and consent and she has stated her age 18 years and learned Magistrate has

Patna High Court Cr.Misc. No.21955 of 2017 (2) dt.19-06-2017 2/2 also assessed her age 18 years, she has stated that nobody has misbehaved with her and, as such, the petitioner deserves sympathetic consideration.

The learned A.P.P. submits that in view of the statement of the victim girl recorded under Section 164 of Cr.P.C. he does not oppose the prayer of bail.

In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur, in connection with Jagdishpur P.S. Case No. 20 of 2017, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
