The petitioner is languishing in custody since 21.04.2015 in connection with POSCO Act Case No. 15/2015, arising out of Ballia P.S. Case No. 134 of 2015 for the offences instituted under Sections 376/511, 354(B) of the I.P.C. and 5(m)/6 and 18 of the POSCO Act.

It is alleged that the petitioner attempted to commit rape upon the minor daughter of the informant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 21.04.2015 and the charge sheet has been submitted in the present case. It is further alleged that the petitioner has got no criminal antecedent. It is further submitted

Patna High Court Cr.Misc. No.25954 of 2015 (3) dt.02-09-2015 2/2 that the petitioner has falsely been implicated in the present case due to local politics.

On behalf of the State it has been submitted that there is direct allegation against the petitioner for committing an offence under Sections 376/511, 354(B) of the IPC. And 5(m)/6/18 of the POSCO Act.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner in connection with POSCO Act Case No. 15/2015, arising out of Ballia P.S. Case No. 134 of 2015, pending in the court of the learned 1st Additional Sessions Judge-cum-Special Judge, POSCO Act, Begusarai. The same is rejected. Anyhow, the court below is directed to take all necessary steps to conclude the trial preferably within a period of one year from the date of receipt/production of copy of this order.
