JUSTICE SUDHIR SINGH ORAL ORDER 17-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 341, 323, 324, 354, 307 and 504/34 of the I.P.C.

The prosecution story, in brief, is that on the alleged date and time of occurrence the accused persons including the petitioner entered into the room of the informant's daughter and petitioner directed other co-accused to lift the victim and also attempted to lift her. In the meantime, her family members came and resisted but they were assaulted by the accused persons including the petitioner by lathi, danda and farsa, on account of which they sustained several injuries on their person. It has been submitted on behalf of the petitioner that

Patna High Court Cr.Misc. No.32532 of 2016 (3) dt.17-09-2016 2/2 the petitioner is in custody since 21.6.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. Nature of injury is simple. General and omnibus allegation has been made against the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Manoj Kumar, learned Judicial Magistrate, 1st class, Siwan in connection with Goreakothi P.S. case No.62 of 2016.
