Mr. Sri Ganesh Prasad Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-12-2018 The petitioner seeks bail in connection with Deo P.S.Case No. 23 of 2018 registered under Sections 304B/34 of the Indian penal Code.

Allegation against the petitioner is of committing dowry death of his wife.

Submission of learned counsel for the petitioner is that witnesses in their statements at paragraph no. 69, 70, 71 and 72, have disclosed that the deceased has committed suicide by locking the door from inside and after breaking open the door dead body was found and postmortem report also discloses that cause of death was due to hanging and petitioner is in custody since 14.03.2018.

Heard learned APP who has opposed the prayer for bail on the ground that petitioner is husband of the deceased and

Patna High Court Cr.Misc. No.60670 of 2018(4) dt.12-12-2018 2/2 witnesses have also supported the case.

Having heard both sides and in in view of the statements of the independent witnesses, as stated above, let the petitioner, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Aurangabad in connection with Deo P.S. Case No. 23 of 2018 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
