The petitioner seeks bail in connection with C2 Case No. 429 of 2021 instituted for the offences under Section 30(a) of the Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 09.09.2021, prosecution report has been submitted in the case and has antecedent of one case. Learned counsel for the petitioner submits that the allegation is of recovery of 171 litres of liquor from the luggage alleged to be thrown by the petitioner.

Learned counsel for the petitioner submits that the

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 09.09.2021 and prosecution report has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-cum-Special Judge, Excise Act, Sitamarhi in connection with C2 Case No. 429 of 2021.
