1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The learned counsel for the petitioners, after arguing vehemently for some times realizing his difficulty, seeks permission to withdraw the anticipatory bail application with respect to petitioner no. 3 (Sonu Kumar).
3. Permission is accorded.
4. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115, 118(1), 109, 303(2) and 3(5) of the BNS, 2023.
5. Learned counsel for the petitioners submits that
Patna High Court CR. MISC. No.58558 of 2025(3) dt.15-11-2025 2/3 petitioner nos. 1 and 2 are persons with clean antecedent and in sum and substance the allegation is that on account of dispute relating to playing of DJ, an altercation took place in which petitioners assaulted the husband of the informant, Arjun Nonia causing injury.
6. Learned counsel for the petitioners submits that on account of dispute relating to playing of DJ, an altercation took place in which both sides assaulted each other. It is also submitted that injury suffered by Arjun Nonia has been opined to be simple though the injury suffered by Rajendra Nonia on head has been opined to be grievous, but then the said injury was caused by Sonu Kumar.
7. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
8. Considering the submissions made by the learned counsel for the petitioners, the petitioner nos. 1 and 2 abovenamed, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with
Patna High Court CR. MISC. No.58558 of 2025(3) dt.15-11-2025 3/3 Simri Bakhtiyarpur P.S. Case No. 498 of 2024 subject to the conditions as laid down under Section 482 (2) of the BNSS.
9. Accordingly, the instant anticipatory bail application stands allowed.
