In this case, the petitioner is seeking bail in connection G.R. No. 1269 of 2016 arising from Barhara P.S. Case No. 95 of 2016 registered for offence under section 394 of the Indian Penal Code.
The petitioner along with other accused persons, entered into the house of informant and started committing robbery. They looted the cash, jewellery kept in the attaichi and also fired upon the informant. Alarm was raised. The people arrived there. The petitioner was arrested from the spot, but other accused persons escaped from there with the money and fire arms. The counsel for the petitioner submits that nothing
Patna High Court Cr.Misc. No.32697 of 2016 (2) dt.20-08-2016 2/2 has been recovered from the possession of the petitioner and the real fact is that it is a case of love affairs and the petitioner has wrongly been made accused in the present case, but the first information report and the fact emerge otherwise. This Court is not inclined to grant bail to the petitioner. Accordingly, this petition is rejected. The court below is directed to conclude the trial within a period of nine months from the date of receipt/production of a copy of this order. If the trial is not concluded within the prescribed period, the petitioner will have liberty to renew his prayer for bail. (Shivaji Pandey, J) Mahesh/- U T
