JUSTICE RAKESH KUMAR ORAL ORDER 01-07-2017 Heard Mr. Sheikh Arkan Ahmad, learned counsel for the petitioners and learned Additional Public Prosecutor . Two petitioners, who are Junior Engineer and S.D.O. respectively in the Electricity Department, have approached this court for extending the privilege of anticipatory bail in Belaganj P.S. Case No. 65 of 2017 registered for offence under section 304 of the Indian Penal Code.

It was submitted by learned counsel for the petitioners that it is true that wife of the informant was electrocuted in view of fall of 33000 Volt Electric Wire but fact remains that petitioners were not directly involved .

Considering the fact that petitioners were Junior

Patna High Court Cr.Misc. No.21868 of 2017 (2) dt.01-07-2017 2/2 Engineer and S.D.O. of the Electricity Department and the nature of accusation, there is no reason to refuse the prayer for anticipatory bail.

Accordingly, in the event of arrest or surrender within a period of six weeks from today, let both the petitioner Priyanka Kumari and Rajesh Kumar be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. XIth , Gaya/ concerned court in connection with Belaganj P.S. Case No. 65 of 2017 subject to the conditions as contemplated under section 438(2) of the Code of Criminal Procedure 1973.
