The petitioner no. 3, namely, Hardeep Singh @ Hardeep Masih seeks bail in Kotwali P.S. Case No. 174 of 2016 registered under Sections 419, 420, 465, 468, 471 & 34 of the Indian Penal Code.

Learned counsel for the petitioners submits that

Patna High Court Cr.Misc. No.35063 of 2016 (6) dt.17-01-2017 2/2 petitioners no. 1, 2 & 4 have already been enlarged on bail vide order dated 20.08.2016. The petitioner no. 3 is ready to return Rs. 1,50,000/- to the informant. It is submitted that the petitioner no. 3 will return Rs. 50,000/- to the informant by tomorrow through a bank draft and the remaining amount of Rs. 1,00,000/- will be returned by the petitioner no. 3 to the informant within two months.

Considering the nature of allegations made against the petitioners and the fact that the petitioner no. 3 is ready to return the entire amount of Rs. 1,50,000/-, which was received by him and his brother Sukhdeo Singh, within two months from the date of this order,the petitioner no. 3, namely, Hardeep Singh @ Hardeep Masih is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in Kotwali P.S. Case No. 174 of 2016, subject to the condition that one of the bailors shall be a local having substantial immovable property as the petitioner no. 3 is a resident of another State. If the petitioner no. 3 fails to return the entire amount within two months from today, the learned court below shall cancel the bail bonds of the petitioner no. 3. Dilip/- (Prabhat Kumar Jha, J) U T
