JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-12-2018 The petitioner seeks bail in connection with Special Case No. 11 of 2018 arising out of Jogbani P.S.Case No. 131 of 2018 registered under Sections 21 and 22 of the N.D.P.S.Act. Allegation against the petitioner is of recovery of articles like Phenargan and other injections from the dickey of motorcycle of one co-accused Amit Kumar and he disclosed the name of this petitioner stating that those articles were to be supplied to the petitioner.

Submission of learned counsel for the petitioner is that FIR itself shows that nothing has been recovered from the possession of this petitioner and he has been made accused on the basis of confessional statement of co-accused Amit Kumar and Amit Kumar has been granted bail by a co-ordinate Bench of this Court vide order dated 09.08.2018 in Cr. Misc. No.

Patna High Court Cr.Misc. No.69474 of 2018(3) dt.14-12-2018 2/2 42803 of 2018 and this petitioner is in custody since 11.09.2018. Heard learned APP also.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Incharge Special Judge, Araria in connection with Special Case No. 11 of 2018 arising out of Jogbani P.S. Case No. 131 of 2018 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
