JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 22.01.2016 on the accusation that one country made pistol, three live cartridges and two fired cartridges are said to have been recovered from his conscious possession when he and three others were caught by the police from the house in which, allegedly, they had taken shelter after committing murder of one person.
Submission on behalf of the petitioner is that nothing has been recovered from conscious possession of the petitioner and, as a matter of fact, on the pressure of villagers, the informant falsely implicated the petitioner in the present case. Accordingly, let the petitioner, above named, be
