JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-07-2015 Heard learned counsels for the petitioner and the State. The petitioner being Panchayat Mukhia is apprehending arrest in a case registered for the offences punishable under Sections 409/34 of the Indian Penal Code.

The accusation is of misappropriating the money under MANREGA scheme to the tune of Rs.4,95,252/- by the petitioner being Panchayat Mukhiya and Panchayat Rojgar Sewak. It is submitted by the learned counsel for the petitioner that on suspicion the petitioner and Panchayat Rojgar Sewak have maliciously been roped in the present case. However, the petitioner undertakes to deposit 60% of the misappropriated amount before the appropriate authority within a period of three weeks.

On deposit of the 60% of the misappropriated amount, since the petitioner is lady and Statement has been made in

Patna High Court Cr.Misc. No.27267 of 2015 (2) dt.22-07-2015 2/2 paragraph 3 of the petition that the petitioner has no criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Muzaffarpur in connection with Paroo P.S. Case No. 168 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
