The petitioner has preferred this application for grant of regular bail in a case registered under sections 413, 414, 467 and 468 of the Indian Penal Code.

As per the prosecution case, seeing the police personnel two accused persons abandoned their motorcycles and escaped. The petitioner was identified to be one of the accused amongst the two who had escaped, by the Chowkidar. It is submitted by learned counsel for the petitioner that neither any incriminating article has been recovered from his possession nor was he arrested at the spot. He has no concern with the allegedly seized article and is in custody since 19.7.2021. Chargesheet has been submitted in the case. Heard learned A.P.P. for the State.

No.68224 of 2021(2) dt.16-05-2022 2/2 Having heard learned counsel for the parties and taking into consideration the petitioner not having been arrested at the spot and having remained in custody for 9 months, the Court directs the petitioner to be enlarged on bail in connection with Derni P.S. Case no. 82 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Ist Class, Saran at Chapra.
