2. Petitioner seeks regular bail in connection with Bihra P.S. Case No. 207 of 2023 dated 12.11.2023 registered for the offences punishable under sections 364, 302, 120B and 201 of the Indian Penal Code.
3. The main submissions advanced by petitioner's counsel are that this is the second attempt of the petitioner to get the relief of bail and his first attempt for the same relief was rejected by this Court vide order dated 22.11.2024 passed in Cr. Misc. No. 36628/2024, giving him a liberty to renew his bail prayer after six months if no significant progress is made in his trial and in the light of the said liberty, he has renewed his
Patna High Court CR. MISC. No.61217 of 2025(3) dt.14-11-2025 2/3 prayer. Though eight prosecution witnesses have been examined in the petitioner's trial but his trial is still running for the examination of the remaining prosecution witnesses and a period of about one year has passed after the rejection of his earlier prayer, but even then, his trial has not been concluded. It is further submitted that one co-accused Prakash Kumar, carrying similar nature of allegation, has been granted bail on his second attempt by this Bench vide order dated 26.09.2025 passed in Cr. Misc. No. 56949/2025. It is further submitted that as per the information, seven material witnesses of the prosecution have not supported the case of the prosecution and went hostile and further, the remaining witnesses of the prosecution are not material, so, the release of the petitioner on bail at this stage will not affect the prosecution adversely and the petitioner has been languishing in jail since 13.11.2023.
4. Though learned APP for the State has opposed the prayer of the petitioner but fairly accepted that seven prosecution witnesses have been declared hostile.
5. Considering the aforesaid submissions and mainly the petitioner's custody period and the status of his trial, as stated above, this Court is now inclined to release him on bail. Accordingly, let the petitioner named-above be released on bail
Patna High Court CR. MISC. No.61217 of 2025(3) dt.14-11-2025 3/3 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the court concerned in connection with Bihra P.S. Case No. 207 of 2023.
