JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-08-2016 The petitioner being husband of the informant is languishing in custody since 31.08.2015 in a case registered for the offences punishable under Sections 498A, 307, 324/34 of the Indian Penal Code but on conclusion of the investigation, final report was submitted under Section 306 of the Indian Penal Code.

The prosecution case is that after seventeen years of marriage the petitioner caused burn injury to the informant and subsequently the informant succumbed to the injuries in the hospital.

It is submitted by learned counsel for the petitioner that in fact the informant has accidentally received burn injury and this fact has also been supported by the daughter of the informant.

Patna High Court Cr.Misc. No.32617 of 2016 (3) dt.18-08-2016 2/2 Judge, Sheikhpura dated 09.08.2016 reflects that the charges have been framed and the trial is likely to be concluded within a period of six months.

Considering the nature of accusation levelled by the victim in the fardbeyan, this Court is not inclined to grant bail to the petitioner at present.

It is expected from learned Trial Court to conclude the trial expeditiously.
