JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2018 Petitioner prays for bail in connection with Shastri Nagar P.S.Case No. 487 of 2018 for the offences punishable under Sections 25(1-B)(a), 26 and 35 of the Arms Act. Allegation as per FIR is that petitioner was apprehended in a vigilance case while posted as BDO at Rampur in the district of Kaimur and thereafter on search one country made pistol and cartridge were recovered from her house.
Submission of learned counsel for the petitioner is that the house is of her husband and search was made in his presence and she is in custody for about four months and in vigilance case she has been granted bail by the court below itself.

Having heard both sides and in the facts and circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IV, Patna, in connection with Shastri Nagar P.S.Case No. 487 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
