The petitioner is in custody since 19.03.2019 in connection with Manjhagarh P.S. Case No.74 of 2019 registered for the offence under Sections 341, 323, 324, 307, 504 and 302/34 of the Indian Penal Code, which is pending in the court of the learned Chief Judicial Magistrate, Gopalganj. Learned counsel for the petitioner submits that the dispute between the parties arose on account of construction of drain outside the house of the deceased and thereafter both the father and son, namely, Nabi Hussain and Gulsheb Alam (the petitioner) came and on instruction from Nabi

Patna High Court CR. MISC. No.55185 of 2019(2) dt.13-09-2019 2/2 Hussain, the present petitioner attacked the husband of the informant in the stomach with a dagger, resulting in his death after ten days.

Considering the fact that the petitioner is the person who mainly attacked the deceased who subsequently succumbed to his injuries, I am not inclined to grant bail to the petitioner. It is, accordingly, rejected. However, the trial of the case may be expedited. (Anjana Mishra, J) PNM U T
