Verma, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 135 of Electricity Act. The accusation is of consumption of electric energy unauthorizedly and the loss has been calculated of Rs.53,290/- apart from arrears of energy charges to the tune of Rs.18,826/-. It is submitted by learned counsel for the petitioner that the arrears of energy charges to the tune of Rs.18,826/- is against the brother of the petitioner. However, the petitioner undertakes to deposit 75% of the loss calculated amount within three months. The said deposit will be subject to the final assessment or compounding proceeding.
Considering the present stand of the petitioner, let the
Patna High Court Cr.Misc. No.25837 of 2015 (2) dt.21-07-2015 2/2 above named petitioner be released on provisional anticipatory bail for four months in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhagalpur in connection with SabourP.S. Case No. 142 of 2012 subject to the conditions as laid down under Section 438(2) Cr.P.C.
The provisional bail of the petitioner shall be confirmed by the learned court below on being shown the receipt of the authorities of deposit of 75% of the loss calculated amount within the aforementioned period.
