JUSTICE BIRENDRA KUMAR ORAL ORDER 11-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.

The occurrence of murder is against unknown.

Name of the petitioner has transpired in the confessional statement of co-accused Ganga Dayal Singh who has already been allowed regular bail by a Coordinate Bench of this Court vide order dated 15.03.2016 passed in Cr. Misc. No. 2830 of 2016.

Considering the fact that only material against the petitioner is the confessional statement of the co-accused which is no evidence in the eye of law, let the petitioner, above named, in

No.32878 of 2016 (5) dt.11-05-2017 2/2 the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar/successor Court in connection with Dumraon (Naya Bhojpur) Police Station Case No. 339 of 2015, G.R. No. 2760/15, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
