The petitioner seeks bail in a case instituted under Sections 323, 324, 307, 379 and 506/34 of the Indian Penal Code. The prosecution story, in brief, is that while the informant along with his neighbour was sprinkling chemical in his field, in the meantime, the F.I.R named accused persons along with the petitioner came there and gave Dabiya blow on the head of the informant, causing injury on his head. It has been submitted on behalf of the petitioner that the petitioner is in custody since 06.06.2016. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of
Patna High Court Cr.Misc. No.34655 of 2016 (3) dt.03-10-2016 2/2 witnesses alleged against the petitioner. The petitioner is said to have assaulted to the informant with Dabiya. The injury is said to be simple in nature. Hence, no offence under section 307 of the Indian Penal Code is made out against the petitioner. On behalf of the state it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Supaul, in connection with Chhatapur P.S. Case No. 228 of 2015.
