JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2018 Petitioner prays for bail in connection with Guraru P.S.Case No. 100 of 2017 registered for the offences punishable under Sections 302, 34 of the Indian Penal Code, 27 of the Arms Act and Section 17 of C.L.A. Act.
Allegation as per FIR is that father of informant was shot dead by miscreants and petitioner is not named in the FIR and later on his name transpired during investigation and petitioner is accused in 14 other cases.
Submission of learned counsel for the petitioner is that no doubt he has been made accused in 14 other cases but most of the case he is on bail and so far this case is concerned, there is nothing against him and he is in custody since 24.3.2018.

No.68078 of 2018(3) dt.20-12-2018 2/2 Having heard both sides and in view of the fact that though petitioner is made accused in several other cases but in the present case there is nothing against him except confessional statement of co-accused, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sherghati, Gaya, in connection with Guraru P.S.Case No. 100 of 2017, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
