JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 19-07-2022 Vide order dated 21.04.2022, the petition of petitioner nos.1 and 2 has already been dismissed as withdrawn. Heard learned counsel for the petitioner no.3 and learned APP for the State.

The petitioner no.3 is apprehending his arrest in a case registered for the offences punishable under Sections 147, 341, 323, 504, 354(B), 324 and 379 of the Indian Penal Code and Sections 8/12 of the POCSO Act.

It is a case of assault and outraged the modesty of the informant and her Nanand by the accused persons including the petitioner.

Patna High Court CR. MISC. No.68474 of 2021(3) dt.19-07-2022 2/2 It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that both parties have sustained injures as alleged in separate incident. So far as petitioner no.3 is concerned, there is general and omnibus allegation and there is no specific allegation against him.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioner, namely, Sandeep Kumar, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO Aurangabad, Bihar in connection with Daudnagar P.S. Case No. 170 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
