====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-10-2023 At the outset, learned counsel for the petitioners seeks permission to withdraw the anticipatory bail application with regard to petitioner No. 1.
2. Permission is granted.
3. The anticipatory bail application with regard to petitioner No. 1 is dismissed as withdrawn.
4. Petitioner No. 2 apprehends arrest in a case registered for the offences punishable under Sections 341, 147, 149, 504, 447, 308, 354 and 379 of the Indian Penal Code.
5. According to F.I.R., allegation against the petitioner is of commission of assault to the informant on his head.
6. It is submitted that injury attributed to this
Patna High Court CR. MISC. No.61853 of 2023(2) dt.17-10-2023 2/2 petitioner is simple in nature. There is case and counter case for the same occurrence. Moreover, F.I.R. has been lodged after delay of 3 days without any plausible explanation for the same. Petitioner claims clean antecedent.

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner No. 2 in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VI, Gaya in connection with Chandauti P. S. Case No. 315 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
