JUSTICE SUDHIR SINGH ORAL ORDER 23-07-2015 The petitioner is languishing in custody since 24.3.2015 in Paroo P.S. Case No.83/15 for the offences under Sections 413, 414, 401 and 471/34 of the I.P.C. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The prosecution story, in short, is that on 23.3.2015 the informant received information that the petitioner including accused persons having formed a gang used to receive stolen motorcycle and after making fake documents sells the said motorcycle to the people and on that very day they were to sell a theft motorcycle on fake documents. On such information the informant along with other police personnel rushed to the place of occurrence but on seeing them the petitioner and his associate

Patna High Court Cr.Misc. No.25958 of 2015 (2) dt.23-07-2015 2/2 started fleeing away but after chase they were caught and they could not produce any valid paper of the same and both were arrested.

It is submitted on behalf of the petitioner that he is in custody since 24.3.2015 and the charge sheet has already been submitted in the case. It is further submitted that no incriminating article has been recovered from possession of the petitioner. The main allegation is against Ramanand Kumar. The petitioner has no criminal antecedent.

On behalf of the State it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Muzaffarpur, in Paroo P.S. Case No.83/15.
