The petitioner is languishing in custody since 19.04.2016 in a case registered for the offences punishable under sections 341, 323, 498A, 504, 34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.

Basic accusation is of torture for non-fulfillment of dowry demand and assaulting the informant with sharp cut weapon and ultimately the informant was driven out from the matrimonial house.

It is submitted by learned counsel for the petitioner

Patna High Court Cr.Misc. No.32719 of 2016 (2) dt.03-08-2016 2/3 that the petitioner admits his marriage with the informant and he is ready to keep the informant as wife with full dignity and honour. A statement to that effect has been made in paragraph 9 of the petition, which reads as under :- "That, petitioner wants to live with informant and wants to maintain her as well as his daughter living in the joint family and he is ready to keep her with full dignity and honour." It is further submitted that the investigation has already concluded and final form (charge-sheet) has been submitted under sections 498A, 506 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. A statement to that effect has been made in paragraph 6 of the petition, which reads as under :- "That it is humbly submitted and stated that Charge sheet vide no.

17/2016 has been submitted on 31.05.2016 against the petitioner and others under sections 498A, 506 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act in the Court below which may be produced at the time of hearing of this case before this Hon'ble Court."

Considering the nature of accusation and the investigation has already concluded, let the above named

Patna High Court Cr.Misc. No.32719 of 2016 (2) dt.03-08-2016 3/3 petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Katihar, in connection with Hasanganj P.S. Case No.17/2016.
