JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 07-02-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Aurai P.S. Case No. 103 of 2021 registered for offence punishable under sections 399, 402 of the Indian Penal Code and sections 25 (1-b)a, 26, 35 of the Arms Act. The learned counsel for the petitioner has submitted that the petitioner is a person of clean antecedent and no any psychotropic substance was recovered from his possession. One of the co-accused persons has confessed his guilt and named the petitioner in his self inculpatory statement, except that, there is nothing against the petitioner.
Considering the above-mentioned facts and
Patna High Court CR. MISC. No.56544 of 2022(2) dt.07-02-2023 2/2 circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge, Muzaffarpur in connection with Aurai P.S. Case No. 103 of 2021, subject to condition as laid down under section 438(2) Cr. P.C.
