JUSTICE RAKESH KUMAR ORAL ORDER 22-08-2016 Heard Dr. Alok Kumar, learned counsel, who was assisted by Sri Virendra Kumar, learned counsel for the petitioner, Sri Arbind Kumar Pandey, learned Addl. Public Prosecutor as well as Sri Ashok Kumar Jha, learned counsel, who has voluntarily appeared on behalf of the informant.

The sole petitioner, who is in custody in Runnisaidpur P.S. Case no. 193/2016 registered for the offence under Section 366(A), 323 and 504 of the Indian Penal Code, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. By way of referring to the statement of the victim girl recorded under Section 164 of the Code of Criminal Procedure,

No.34756 of 2016 (2) dt.22-08-2016 2/2 copy of the same has been brought on record as Annexure-2 to the petition, it was submitted by learned counsel for the petitioner that the victim girl herself has disclosed her age as 18 years and she has categorically stated that she had solemnized marriage in a temple with the petitioner and she wanted to live with her in-laws. Learned Addl. Public Prosecutor and learned counsel for the informant, though, vehemently opposed the prayer for bail of the petitioner, they were not in a position to dispute the fact as disclosed in the statement of the victim girl recorded under Section 164 of the Code of Criminal Procedure. In view of facts and circumstances, let the petitioner, namely, Navin Sahni be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Runnisaidpur P.S. Case no.193/2016.
