The petitioner apprehends his arrest in Srinagar P.S. Case No. 48 of 2021, registered for the offences punishable under Sections 307, 354(B) and other allied sections of the Indian Penal Code.

As per the prosecution case all the accused persons including this petitioner assaulted the informant with lathi, danda and co-accused Badruddin assaulted with Dabia causing head injury to the informant.

It is submitted that there is case and counter case. The wife of one of co-accused Rehat Parween lodged a case bearing Srinagar PS Case No. 47 of 2021 against the informant and

Patna High Court CR. MISC. No.68352 of 2021(2) dt.18-07-2022 2/2 family members which is earlier in point of time. Injury sustained by the informant is found to be simple in nature which is attributed to this petitioner. Moreover, the victim girl in her statement under Section 164 has not taken the name of this petitioner. No specific allegation of overt act has been alleged against this petitioner. Petitioner claims clean antecedent. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge VI-cumSpecial Judge POCSO, Madhepura in connection with Srinagar P.S.
