The petitioner is apprehending his arrest in connection with Bakhari P.S. Case No. 85 of 2016 instituted for the offences punishable under Sections 447, 341, 323, 504, 506, 353, 224, 225/34 of the Indian Penal Code.
The prosecution case, in brief, is that on secret information that the accused persons of Bakhari P.S. Case No. 208 of 2015 talking in front of the house of Munna Rai, police party came there. Seeing the police party, the accused persons tried to flee away, but caught. Some accused persons also torn the arrest memo of the accused.
It has been submitted on behalf of the petitioner that the
Patna High Court Cr.Misc. No.32936 of 2016 (2) dt.09-12-2016 2/2 petitioner has been falsely implication in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. General and omnibus allegation made against the petitioner. At the relevant time of occurrence, the petitioner was being treated at Delhi.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Begusarai in connection with Bakhari P.S. Case No. 85 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
