JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-07-2015 Heard learned counsels for the petitioner and the State. The petitioners are languishing in jail since 17.04.2015 in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323 and 307 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged that the informant's co-villager Dhanik Lal Singh along his two sons Sanjit Singh and Ranjit Singh and nephew Vikaram Singh came with two tractors and started ploughing the disputed land, on protest being made petitioner no.2, Sanjit Singh fired which caused injury to the buffalo, thereafter, Ranjit Singh, Vikaram singh, Kulkul Yadav, Yogendra Yadav, Rasindra singh, Hareram Yadav, Sanjeev Singh and ten

Patna High Court Cr.Misc. No.26625 of 2015 (2) dt.28-07-2015 2/2 others came there and assaulted the informant and his cousin brothers Raj Lal Yadabv and Bilaxan Yadav.

It is submitted by learned counsel for the petitioners that though, some of the injuries have been found grievous on the informant's side but the accusation of assault is omnibus and general against 15 accused persons in the background of serious land dispute and investigation has already concluded. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on bail, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Madhubani in connection with Ladania P.S. Case No. 42 of 2015.
