Petitioners are apprehending their arrest in Jadia P.S. Case no. 133 of 2016 for the offences registered under Sections 341, 323, 324, 325, 354A, 379, 504, 506 and 307/34 of the Indian Penal Code.
It is alleged that petitioners assaulted the informant and snatched one silver chain, gold earring and cash of Rs. 11,000/-.
It has been contended on behalf of the petitioners that
Patna High Court Cr.Misc. No.22512 of 2017 (2) dt.01-06-2017 2/2 they have got clean antecedent. Except petitioner no. 1 there is no specific allegation against rest of the petitioners. It has been further contended that matter has been compromised between the parties and a compromise petition to that effect has been filed in the court below.
Considering the facts and circumstances of the present case, anticipatory bail of petitioner no. 1 is hereby rejected. However, petitioner no. 1 may surrender in the court below and pray for regular bail which shall be considered and disposed of by the court below without being prejudiced by the order of this Court.
Let petitioners no. 2 to 9, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-IVth, Supaul, in Jadia P.S. Case no. 133 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
