03-03-2022 Heard learned counsel for the parties.

The petitioner seeks bail in Dumraon P.S. Case No. 370 of 2021, registered for the offence under Section 307 & other allied sections of the Indian Penal Code and Section 27 of the Arms Act.

As per the F.I.R., while the informant was constructing boundary wall on his land, all the F.I.R. named accused persons alongwith 8 - 10 unknown persons came there and started breaking the wall. It is further alleged that coaccused Rajan Tiwari started firing indiscriminately, but anyhow informant saved his life and thereafter, co-accused Rajan Tiwari fired upon one Arvind Kumar, who came to save the informant, due to which, he got injured and fell on the ground. However, learned counsel for the State and informant have opposed the bail petition and submitted that petitioner was also present at the place of occurrence.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Buxar in connection with Dumraon P.S. Case No. 370 of 2021.
