The petitioner apprehends his arrest in connection with Aurangabad (H) P.S. Case No. 50 of 2015 registered under Section 419 and 420 of the Indian Penal Code. The accusation is that one Jitendra Kumar was found sitting in the examination hall of matriculation examination in place of petitioner Rahul Kumar.
Having considered the facts and circumstances and nature of the allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail of the petitioner is rejected. The petitioner may surrender before the court below within
Patna High Court Cr.Misc. No.13420 of 2017 (2) dt.02-05-2017 2/2 a period of four weeks and make prayer for regular bail which will be considered on its own merit without being prejudiced by the order of this court.
