The petitioner seeks regular bail in connection with Jaipur P.S. Case No. 48 of 2022 registered for the offence under Sections 420, 467, 468, 471, 120(B) of the Indian Penal Code. As per prosecution story, the informant conducted inspection against forged govt. teacher and during course of inspection, he found that the petitioner got appointment on the post of Teacher in Pronnat Middle School, Kerwar on the basis of forged certificates.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. She has falsely been implicated in this case. The petitioner passed matriculation from BSEB in the year 2000 thereafter, she completed intermediate from National Institute of Open
Patna High Court CR. MISC. No.56642 of 2022(2) dt.16-02-2023 2/2 Schooling in the year 2007 and thereafter she also completed teacher training from BSEB, Patna with 2nd division, during the service of Panchayat Teacher. She also passed Elementary Teacher Evaluation Examination-2016 conducted by Education Department, Patna thereafter, she was appointed on the post of Panchayat teacher w.e.f. 13.8.2010 after process of selection, her educational certificates have been verified by the authority and the salary was being paid to her. She has got no criminal antecedent. Moreover, the petitioner is lady and languishing in judicial custody since 21.8.2022.
Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Jaipur P.S. Case No. 48 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-I, Banka. (Sunil Kumar Panwar, J) amandeep/- U T
