Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State and also heard learned counsel for the informant.

Petitioner is named in the first information report and it is alleged that he ordered others to kill the deceased. The contention on behalf of the petitioner is that petitioner has been roped in this case on account of political rivalry. On the contrary, learned counsel for the informant opposed the prayer submitting that at the instance of the petitioner, deceased was killed by other accused.

Considering the aforesaid facts and circumstances as well as submissions of the parties, particularly, keeping in mind that petitioner does not have criminal antecedent and one co-accused, against whom there is allegation that he caught hold of the deceased at the time of
