The petitioner being the husband of the informant is languishing in custody since 20.06.2016 in a case registered for the offences punishable under section 498A/34 of the Indian Penal Code, 3/4 of the Dowry Prohibition Act and 67 of the Information Technology Act.

Prosecution case is of inflicting torture for nonfulfillment of dowry demand and uploading the photographs of the informant with vulgar comments on the social site i.e. Facebook.

It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the informant and he is ready to keep the informant as wife with full dignity and

Patna High Court Cr.Misc. No.32664 of 2016 (3) dt.10-08-2016 2/2 honour. A statement to that effect has been made in paragraph no.8 of the petition, which reads as under :- "8. That it is also relevant to submit here that the petitioner is ready to keep her wife with full dignity." It is submitted by learned counsel for the informant that the informant is ready to accept the offer of the petitioner but she is apprehensive due to the past conduct of the petitioner. Considering the present stand of the parties, let the above named petitioner be released on bail provisionally for three months, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Chapra, Saran, in connection with (Saran) Mahila P.S. Case No.49/2014.

The provisional bail of the petitioner will be confirmed by the learned Court below on substantial restoration of matrimonial harmony or, if the complainant fails to appear before the Court below.
