JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 07-07-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Ladania P.S. Case No. 150 of 2015/ G.R. No. 2876 of 2015 for the offences punishable under sections 467, 406, 420, 323, 342 and 504/34 of the I.P.C. Allegedly, the petitioner assured the informant regarding the land sold by accused nos. 1 and 2 as free from the dispute and inspite of request made to return the amount assurance was given to give possession over the land but the accused nos. 1 and 2 evaded the matter and the petitioner did not help the informant.

Submission is of false implication and that the

No.22555 of 2017 (3) dt.07-07-2017 2/2 petitioner has got no concern with the alleged sale and purchase, he has been made accused only on surmises and conjecture, he has got no concern with accused nos. 1 and 2, he has not received any amount from the informant and without any fault he has been made accused.

The learned A.P.P. opposes prayer for pre-arrest bail of the petitioner.

In the facts and circumstances as stated above, considering that the petitioner is not vendor, he has not received any amount and as such the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. J.M. 1st Class- Cum- Munsif-II, Madhubani in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) Abhay/- U T
