Petitioner seeks bail in Rupaspur P.S. Case No.237 of 2018 instituted for the offence under Section(s) 323, 325, 498-A, 306/34 Indian Penal Code pending in the Court of the Additional Chief Judicial Magistrate, Danapur, Patna. Petitioner is husband of the deceased.
In the written report, it is alleged that daughter of the informant was married about eleven years back. Petitioner was unemployed at the time of marriage. Presently, he is working in DRDA. The petitioner always tortured the daughter of the informant for rupees three lac. Daughter of the informant had two sons out of the wedlock. Behaviour of the petitioner towards his daughter was not good from very beginning. She once attempted to commit suicide and a suicide note was found
Patna High Court Cr.Misc. No.66222 of 2018(3) dt.18-12-2018 2/2 by informant. Thereafter, daughter of the informant was murdered on 14.06.2018 by the petitioner and his family members. The information was sent to the informant through younger son of the deceased. The informant has enclosed suicide note of the victim girl in the last part of the First Information Report.
From the aforesaid suicide note, it appears that behavior of the petitioner towards his wife (since deceased) was not good from very beginning. He never gave proper support to the daughter of the informant.
Counsel for the State submits that cause of death was asphyxia due to hanging.
The daughter of the informant died unnatural death in her Sasural. The suicide note indicates cruel behaviour of the petitioner with the victim from beginning.
In such circumstances, this Court is not inclined to enlarge the petitioner on bail.
Prayer of the petitioner for grant of bail is rejected at this stage.
