JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 26-08-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Korha P.S. Case No. 141 of 2016 registered under Sections 341, 323, 307, 379 and 34 of the Indian Penal Code. The accusation is that on 01.06.2016, when the informant was at his fertilizer shop, petitioner along with Md. Tauhid and 4 others came at his shop and petitioner gave iron rod blow at his head, which missed and he sustained injury near his eyebrow. In that course, Md. Tauhid snatched gold chain of Rs. 10,000/-.

Learned counsel appearing on behalf of the petitioner submits that in fact, petitioner and informant are co-

Due to that reason, hot exchange took place and the informant lodged the present case against the petitioner. Moreover, only one injury is found on the person of the informant caused by sharp substance. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Katihar in connection with Korha P.S. Case No. 141 of 2016 subject to the condition as laid down under Section 438(2) of the Cr. P.C.
