The petitioners apprehend their arrest in connection with Bithan P. S. Case No. 35 of 2017 instituted under Sections 307, 323, 341, 504 and 506/34 of the Indian Penal Code. The allegation, in brief, is that when informant enquired who has broken asbestos of her house, upon this, accused persons started abusing and assaulted her with leg and fist and one Md. Ehsan, son of Md. Basir Ahmad, tried to strangulate her. It is submitted that there is land dispute between both the sides so these petitioners have been falsely implicated in this case and the petitioner no. 2 is the nephew of the informant and there is no allegation of strangulation against him rather it is

Patna High Court Cr.Misc. No.29095 of 2017 (2) dt.13-07-2017 2/2 against Md. Ehsan, son of Md. Basir Ahmad.

Having considered the aforesaid facts and circumstances, let petitioners, namely, Md. Ahsan @ Md. Ehsan and Md. Rizwan in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Rosera, Samastipur in connection with Bithan P.S. Case No. 35 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973. (Arun Kumar, J) Sujit/- U
