This application for anticipatory bail arises out of Bibhutipur P.S Case No. 208 of 2018, disclosing offences under Sections 420, 467, 471 and 120B of the Indian Penal Code. The petitioners are working as Prakhand Teachers. With the allegation that in course of inquiry conducted under the orders of this Court, the petitioners have been found to have used forged and fabricated experience certificate(s) for the purpose of obtaining employment, the FIR has been registered. Learned counsel, appearing on behalf of the petitioners, submits that the petitioners are still working as Prakhand Teachers and their services so far have not been terminated. He has also submitted that the allegation of submitting forged and fabricated experience certificate(s) at the time of process of selection by the petitioners is incorrect.

No.70264 of 2018(3) dt.17-12-2018 2/2 Considering the nature of allegation and the facts that the petitioners have been allowed to work as Prakhand Teachers, despite registration of the FIR, this application is allowed Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each, with two sureties of the like amount each, to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Rosera, Samastipur in Bibhutipur P.S. Case No. 208 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bond shall be liable to be cancelled.
