ANJANA MISHRA ORAL ORDER 26-09-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
Petitioners are apprehending their arrest in connection with Kharagpur P.S. Case No. 31 of 2016 registered for the offences punishable under Sections 328 and 302/34 of the Indian Penal Code.
The allegations against these petitioners are that they have administered poison to the brother of the informant. The petitioner no.1 is the mother-in-law of the deceased whereas petitioner no.2 is the wife, who had been living away from the family of the present informant.
Considering the nature of allegation made against these petitioners and that the allegation has been made out only on
Patna High Court Cr.Misc. No.34218 of 2016 (4) dt.26-09-2016 2/2 the basis of conjectures and surmises and further because these petitioners have no criminal antecedents, let the petitioners above named, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Munger in connection with Kharagpur P.S. Case No. 31 of 2016 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
