JUSTICE SUDHIR SINGH ORAL ORDER 20-10-2016 Heard learned counsel for the petitioner, the State and the informant.
The petitioner seeks bail in a case instituted for the offences under Sections 302 and 201/34 of the I.P.C. Allegation is that the accused persons including the petitioner committed the murder of the informant's husband and thrown his dead body in a pond.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 5.5.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. In the F.I.R. only suspicion has been raised against the petitioner. The mother of the deceased has filed a separate case making allegation against
Patna High Court Cr.Misc. No.35126 of 2016 (3) dt.20-10-2016 2/2 the informant in respect to the commission of the murder of the deceased. There is no eye witness to the alleged occurrence nor there is any substantive evidence to suggest his implication in the present case.
On behalf of the State and the learned counsel for the informant, it is submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Runnusaidpur P.S. case no.122 of 2016.
